Nope uou misunderstand this process.
*They* do not flag anything.
The registrant or registrant's agent agrees to Nominents 'consumer/ 
(used to be called individual)' opt out mechanism in the TaC when they 
sign the agreement
I myself use it on one of my domains, which is a consumer and none 
commercial site. I had to agree to a contract that I was in fact an 
individual and that I wanted to opt out. It's not automated and is open 
to abuse because anyone can lie and say they are an individual.

         THE REGISTRANT IS AN INDIVIDUAL "WHO HAS ELECTED [*Note Bien*]" TO
         HAVE THEIR ADDRESS OMITTED FROM THE WHOIS DATABASE
