no it wouldn't. FTC can define it anyway they want. 47 USC 230 and Section
8(c) of 'you can spam' both say that we can block anything we find
'otherwise objectionable'. If the FTC tried to put a dnsbl out of
business, they would quickly find themselves on the losing side of a free
speech lawsuit, trying to explain why the majority opinion in Rowan vs. UPS
doesnt apply.
Besides, SORBS and Spamhaus seem to be highly reliable, and they are in
Australia and UK respectively. Kind of hard to shut them down.
