No I am not saying that... The facts probably do implicate Van Essen and
by his own admission he was an EyeFive affiliate who used spamming to
sell the product and by his account with the full knowledge and
assistance of EyeFive.
Van Essens words....
Eyefive was supplying many companies, like ours(well....not actually
supplying, because they processed and shipped all orders)
This indicates no physical transaction of product took place.
In legal terms, me not being all that well versed, this means EyeFive
is responsible for the way its product is sold and most likely puts them
within reach of the CAN-SPAM act for knowingly supporting the spammers.
What I am saying is that EyeFive is the ring leader not Van Essen.
Van Essen is currently facing jail time if he is caught.
There are new laws in Australia and I am informed that the grace period
that has been notified to know recidivist offenders runs out on the 15th
of April.
Yet the EyeFive VP-RX spam continues and Van Essen states he is no
longer involved. EyeFive state they are no longer supplying Van Essen.
I have a pdf file from the lawyers.
The modus operandi of the VP-RX spammers has not changed. Close to the
trojaned machines infector as stated by spamhaus. They seem to know were
to find unlisted trojaned machines at will.
So which lier do I believe...
I have been on the case of EyeFive since the VP-RX spam started in my
inbox. In the early days as pointed out on the spamhaus web site the
affiliate program run by EyeFive and EyeFive itself were clearly
identified. I don't know if there are any domains registered to EyeFive
now days but there certainly used to be.
I tend to favour Van Essen although undoubtadly I could be wrong.
