For anyone who is following this, the latest response from Evesham is:

"For the past 6 months there have been no complaints.  We found out that
there was some doubt about whether people had opted in to the previous
mailing list we had obtained and this is our last attempt to clean it by
sending out this opt in email.  If it is ignored, the user should not
receive another email from us again."

Hmm... sounds kinda spammy to me!
