If it were that cut and dry, I suspect that Brand X might have gotten some 
support from municipalities in making their argument and the court decision 
would've been different.  I understand your points...its a very gray area 
without seeing actual contracts though.  I suppose municipalities could 
revoke the franchise or whatever.  It'd probably just stir up a lot of angst 
though.  For example, everytime any one of my customers has contracted for 
DSL from someone other than SBC, there have been huge delays.   And service 
from all the DSL providers is atrocious.  What a mess!  How would you 
prevent the same crap from happening with cable?

I think once you allow a monopoly to form, its a hell of a job to get 
competition into the market without a lot of grief.  Yeah, you might get it 
in some specific areas, but the competitors will just try to cherry pick the 
best customers/areas...so, the benefits never really reach the masses 
anyway.
